1. Introduction

Welcome to ComplaintNest ("we," "our," or "us"). These Terms & Conditions govern your use of the ComplaintNest website, mobile applications, and services (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our Platform.

2. Definitions

In these Terms & Conditions:

  • "User" refers to any individual who accesses or uses the Platform.
  • "Complaint" refers to any report, grievance, or issue submitted by a User through the Platform.
  • "Company" refers to any business or organization that is the subject of a Complaint.
  • "Content" refers to any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Platform.

3. Account Registration

To use certain features of the Platform, you may need to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Be responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, outdated, or incomplete.

4. Complaint Submission

When submitting a Complaint through our Platform, you agree to:

  • Provide accurate and truthful information about your experience.
  • Only submit Complaints based on your personal experience or with proper authorization.
  • Not use the Platform to harass, defame, or intentionally harm the reputation of any Company.
  • Acknowledge that your Complaint may be reviewed by our AI system for verification purposes.
  • Understand that ComplaintNest does not guarantee resolution of your Complaint.

By submitting a Complaint, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute the Complaint and any associated Content.

5. Legal Acknowledgment

When submitting a Complaint, you may be required to provide a legal acknowledgment confirming that:

  • The information provided is true and accurate to the best of your knowledge.
  • You understand that submitting false information may have legal consequences.
  • You authorize ComplaintNest to share your Complaint with the relevant Company and, if necessary, appropriate regulatory authorities.

This legal acknowledgment is binding and may be used as evidence in legal proceedings if necessary.

6. Company Responses

Companies may respond to Complaints submitted through our Platform. We do not:

  • Guarantee that any Company will respond to a Complaint.
  • Endorse or validate any Company's response.
  • Take responsibility for the content or accuracy of any Company's response.

Users and Companies are solely responsible for the content of their communications through the Platform.

7. Payment Services

For certain legal resolution services, we may charge fees. By using these services, you agree to:

  • Pay all applicable fees as described on the Platform.
  • Provide accurate billing information.
  • Acknowledge that all payments are non-refundable unless otherwise stated.

We use third-party payment processors (PayPal and Skrill) to process payments. Your use of these services is subject to their respective terms and conditions.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any laws.
  • Post or transmit any Content that is defamatory, harassing, threatening, or offensive.
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform.
  • Attempt to gain unauthorized access to any part of the Platform.
  • Use any robot, spider, or other automated device to access the Platform.
  • Collect or store personal data about other users without their consent.

9. Intellectual Property

The Platform and its original content, features, and functionality are owned by ComplaintNest and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our Platform without our prior written consent.

10. Limitation of Liability

In no event shall ComplaintNest, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Platform.
  • Any conduct or content of any third party on the Platform.
  • Any content obtained from the Platform.
  • Unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless ComplaintNest and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Platform.
  • Your violation of any term of these Terms & Conditions.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
  • Any claim that your Content caused damage to a third party.

12. Changes to Terms & Conditions

We reserve the right to modify or replace these Terms & Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.

13. Governing Law

These Terms & Conditions shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms & Conditions will not be considered a waiver of those rights. If any provision of these Terms & Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms & Conditions will remain in effect.
